The dates are big and clear. The signatures are signed just as the name is printed. The recission dates are clear and correct. The forms are filled out completely.

Many times documents are presented to an SD Signings notary public that require a signer to be identified by a name that isn’t printed on their Identification. For Example, a signer must sign “Joesph Presley Cook” on a document. The Notary views the signer’s driver’s license and it reads “Joseph Cook”. The notary public is unable to verify that this person has the middle name “Presley”.  The SD Signings Notary cannot notarize the document as it requires. What does the notary do?

On many occasions SD Signings notaries will drive the extra miles to see a satisfactory identification that reads all the correct names. That’s right, with the signer’s permission, we will leave the signing location and follow a signer to obtain a proper ID. This is crucial to identifying an indiviual properly. We do this so that others are not affected. It is a courtesy, and it protects Californians and others from fraud.  It also provides that a transaction affecting multiple parties can process without the delay of redrafting docs. In a loan transaction many people have worked hard for this transaction to process!  It is better to drive the extra mile to get a job done right.

Unfortunately, if there is no identification, whether a physical ID Card or Credible Witnesses, then the notary will continue to protect all agencies from likely fraud, and politely decline. Fortunately, that typically isn’t the case, the signers and transaction coordinators are pleased with a job well done!

SD Signings has experienced notary agents for Provident Funding Loans. We are able to Provide San Diego agents with the necessary 500,000 E&O. We understand the guidelines and expectations for a successful provident signing.

Need a mobile notary 7:00am Sunday morning? How about 11:30pm wednesday night? We are Available! We come to you! Our mobile notary services have helped many who need a last minute notary.  Our mobile notaries are friendly and experienced. We provide services to help in the process of an Apostille, Estate Plans, Health Documents, Loan Documents, Deeds, Powers of Attorney and more!  Think about the convenience of a mobile notary today. We travel mobile all day every day and know San Diego!  There is no need to leave your home, office or hotel room. We know San Diego, We’ll travel to you!

The best bet to keep everyone happy is to keep everyone updated.  At SD Signings we determine the most appropriate method for contact and update the parties involved continually. If something is important we make the immediate phone call to the necessary party. If the information is less important, yet meaningful, we shoot an email. It’s a courtesy to the parties involved and it puts everyone at ease knowing that the closing is progressing. When the the rate lock expires soon on a refinance, everyone is a little anxious to know that things are moving along OK. The worst thing a notary can do is disappear.

Keep everyone posted!

  • Call the Borrower and arrange a time.
  • Docs haven’t arrived?  let everyone know.
  • Signing extended past the overnight drop, drop a line.
  • Signing complete, confirm with escrow and/or lender.
  • Docs overnighted? Affirm by email with a tracking number.
  • Problem arose? call immediately!

Again, it’s common courtesy. All the parties involved have worked hard to get to these final steps, it’s your time to shine.  Communication will ensure a healthy relationship with the business that called you, your borrower, and anyone else involved.

Really the main purpose of a Notary Public is to detour Fraud.  SD Signings takes many special steps to to detour Fraud in order to protect the people of California and elsewhere.  Although many of these steps are not absolute requirements as they are not required by law, our clients typically cooperate in an effort to protect themselves and others.  Many of  these steps are required by law and we do cooperate by these standards fully.

  • SD Signings takes a thumb print for every notarization, deed or not.
  • We’ll find professional witnesses for additional confirmation of competence and willingness.
-Many times a nearby doctor or specialist is willing to sign as a witness of a person’s ability to understand, this way years down the road
a person’s willingness to sign a document is protected by the Notary and other witnesses. There isn’t a question!
  • If a situation seems awkward or fraudulent, we’ll leave! Our task as a public servant is to detour fraud. If someone is being coerced or seems unwilling we will leave the situation, and if necessary, report it.
  • If we are unable to understand a person because of a language barrier, we will not proceed.  On the other hand if a document is written in another language and a signer requires a notarization, we will provide this as we are legally available.
  • Proper Identification please. Your government issued ID must include a Photo, Physical Description, Serial Number and Signature.  We will only provide a notarization for the name we can identify by proper identification. If your document requires a notarization for a name that is followed by “Jr”, the identification provided must provide the same to properly identify you.
  • California Notaries are unavailable to Identify a title on your notary attachments. “President”, “Owner”, “Founder” are all titles that cannot be accounted for on a notary attachment.
  • Raise your Right hand! If you are swearing or affirming to a Jurat or Affidavit,  raise that right hand.

As you can see, we take special precautions to offer you quality service. Sometimes these steps seem like they can be nuisance, but in the end they protect everyone! For more special steps give us a call at SD Signings (619) 442-8585 concerning your situation. We are not attorneys and are unavailable to provide legal advice concerning your documents. The above SD Signings guidelines are steps that we may follow to ensure safety but are not necessarily required by law.

Article from the National Notary Association “What is a Notary?”

What is a Notary Public?
A Notary Public is a public servant appointed by state government to witness the signing of important documents and administer oaths.

Why are documents notarized?
Documents are notarized to deter fraud and to ensure they are properly executed. An impartial witness (the Notary) identifies signers to screen out impostors and to make sure they have entered into agreements knowingly and willingly.

How does a Notary identify a signer?
Generally, the Notary will ask to see a current identification document or card with a photograph, physical description and signature. A driver’s license, military ID or passport will usually be acceptable.

Is notarization required by law?
For many documents, yes. Certain affidavits, deeds and powers of attorney may not be legally binding unless they are properly notarized. With other documents, no. Private entities and individuals may require notarization to strengthen the document and to protect it from fraud.

Does notarization make a document “true” or “legal”?
No. A notarization typically means the signer acknowledged to the Notary that he or she signed the document or vouched under oath or affirmation that the contents of the document were true.

May a Notary give legal advice or prepare legal documents?
Absolutely not. A Notary is forbidden from preparing legal documents or acting as a legal advisor unless he or she is also an attorney. Violators can be prosecuted for the unauthorized practice of law, so a Notary cannot answer your legal questions or provide advice about your particular document.

Can a Notary refuse to serve people?
Only if the Notary is uncertain of a signer’s identity, willingness, mental awareness, or has cause to suspect fraud. Notaries may not refuse service on the basis of race, religion, nationality, lifestyle, or because the person is not a client or customer.

Do you remember your first loan signing?  Half way through the 15th page you had realized the signers were using purple and pink pens.  Their signatures didn’t even remotely match the names printed below the lines.
The initials had smiley faces in place of middle name initials. All the dates looked like mush, and your right to cancel pages all effectively canceled the loan package flat before you even got your… “oh no, the thumbprints!!”..

As you have matured as a Notary Public and Signing Agent you have found yourself briefing the borrowers with the “rules of the loan signing”  prior to any action. You might have flipped through the documents in advance to  prepare for the recording of your journal. Your thumb prints most likely even come first now.

Sometimes we might still find ourselves in a jam like our first day’s work. Was it because you didn’t emphasize enough the need for blue ball point ink before your signer swapped pens for his favorite sharpie?

Imagine this, create a worksheet for your borrower that declares the “must dos” in the loan signing. A declaration of what a successful signing demands.
Your List could include some of the following:

USE BLUE BALL POINT INK  _______  <initial here

IF YOUR NAME READS JOHN D SMITH,
INITIAL “JDS” _______  <initial here

MAKE ALL DATES BIG AND CLEAR IN THE
FOLLOWING FORMAT “00/00/0000″_______  <initial here

WHEN YOU SEE THE “RIGHT TO CANCEL”
…STOP FOR INSTRUCTIONS_______  <initial here

(ETC…)

Have the Borrower see the necessity of everything you must do before you sign. This will be one more step to ensure a successful signing and smooth sailing.
